By downloading, installing, or using MedTRACK (“the app”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the app.

2. Acceptance of Risk

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

• Your use of the app is at your sole risk
• Any reliance on the app’s functionality is at your own risk
• You are solely responsible for any damage to your device or loss of data that results from using the app
• You are solely responsible for any medical decisions made in connection with using the app

3. Medical Disclaimer

IMPORTANT MEDICAL NOTICE - PLEASE READ CAREFULLY:

• MedTRACK is a tracking tool only and NOT a medical device
• The app is NOT FDA-approved and is NOT intended to diagnose, treat, cure, or prevent any disease
• The app is NOT a medication reminder system and should NOT be relied upon for medication timing
• The app does NOT provide medical advice or recommendations
• NO doctor-patient relationship is created by using this app
• ALWAYS follow your healthcare provider’s instructions regarding medications
• In case of medical emergency, contact emergency services immediately
• DO NOT use this app as a substitute for professional medical judgment
• Consult qualified healthcare providers regarding all medical conditions and treatments

4. Critical Disclaimers and Limitations

4.1 Warranty Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Error-free or uninterrupted operation
• Accuracy of any data or information
• Security of your data
• Compatibility with your device or software

4.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages
• This includes but is not limited to:
  • Personal injury
  • Medical complications
  • Loss of data
  • Loss of privacy
  • Financial loss
  • Any other losses or damages
• Our total liability shall not exceed the amount you paid for the app
• These limitations apply even if we have been advised of the possibility of such damages

5. User Responsibilities

You are solely responsible for:

• The accuracy of all medication information entered
• Maintaining the security of your device and data
• Any activity that occurs under your account
• Backing up your data
• Verifying any information with healthcare providers
• Following proper medical advice from qualified professionals
• Any consequences resulting from your use of the app

6. Data & Privacy

6.1 Data Management

• You retain all rights to your personal health information
• You are responsible for maintaining the confidentiality of your health information
• Data synced through iCloud is subject to Apple’s Terms of Service
• Deleting the app will remove all local data
• We are not responsible for any data loss or breach

6.2 No Guarantee of Data Security

While we implement reasonable security measures:

• We cannot guarantee the security of your data
• We are not responsible for any unauthorized access to your data
• We are not responsible for any interception of data transmission
• You acknowledge these risks by using the app

7. Prohibited Uses

You agree not to:

• Use the app for any unlawful purpose
• Attempt to gain unauthorized access to the app or its systems
• Interfere with the app’s functionality
• Copy, modify, or create derivative works of the app
• Reverse engineer or decompile the app
• Remove any copyright or proprietary notices

8. Intellectual Property

• The app and all related content are protected by copyright and other intellectual property rights
• All trademarks, service marks, and trade names are proprietary
• No license to any intellectual property is granted except for normal use of the app

9. Termination

We may terminate or suspend your access:

• Immediately, without prior notice or liability
• For any reason, including breach of these Terms
• Without any refund of previously paid fees

10. Indemnification

You agree to indemnify, defend, and hold harmless MedTRACK and its officers, directors, employees, agents, and affiliates from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with:

• Your access to or use of the app
• Your violation of these Terms
• Your violation of any third party right
• Any harm caused to any person as a result of your use of the app

11. Changes to Terms

• We reserve the right to modify these Terms at any time
• Changes are effective immediately upon posting
• Your continued use of the app constitutes acceptance of modified Terms

12. Severability

If any provision of these Terms is found unenforceable:

• That provision will be enforced to the maximum extent permissible
• The remaining provisions will remain in full force

13. Governing Law

• These Terms are governed by United States law
• You agree to submit to the personal jurisdiction of the federal and state courts located in California

14. Entire Agreement

These Terms constitute the entire agreement between you and MedTRACK regarding the app, superseding any prior agreements.
